Terms of Use

These Terms are a binding agreement between you and Brain Hub, an MSME (Micro enterprise, Services) registered under UDYAM, a software/IT services enterprise (NIC 62011: Writing, modifying, testing of computer programs), with Udyam Registration No. UDYAM-UP-02-0127470, which operates India Opinion. India Opinion is a product of Brain Hub. In these Terms, Brain Hub is referred to as "we". These Terms govern your use of India Opinion. They are an electronic record under the Information Technology Act, 2000 and the rules made under it, and they also serve as the rules and user agreement required by Rule 3(1) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

1. Eligibility

You must be at least 18 years old and able to enter a binding contract under the Indian Contract Act, 1872. Each person may hold only one account, verified with their own mobile number.

2. One person, one vote

You may vote once per question. Using multiple accounts, other people's numbers, bots, scripts, VPN farms or any other method to inflate or manipulate votes is prohibited. We may cancel suspicious votes and suspend accounts that do this.

3. Nature of polls

Polls are unscientific opinion surveys of app users. They are not exit polls, forecasts or official results, and they are not affiliated with the ECI, any government or any party. Results are automatically hidden during ECI blackout periods under Sections 126 and 126A of the Representation of the People Act, 1951, and other legal restrictions. You must not publish or share results in breach of those laws.

4. Prohibited conduct

You must not host, upload, share or ask the AI to produce content that:

• is obscene, defamatory, invades privacy, or is harassing, hateful, or promotes enmity between groups on grounds of religion, caste, race, language or region
• is harmful to children
• infringes intellectual property
• is knowingly false or misleading, including deepfakes or impersonation
• threatens India's unity, integrity, security, sovereignty or public order
• contains malware
• breaks any law, including election law and the Model Code of Conduct

You must also not scrape, reverse-engineer or overload the Service. We may remove content and suspend or terminate accounts that break these rules, as Rule 3(1)(b) and (c) allow.

5. AI features

The AI Assistant and AI Voice Call can make mistakes. Their answers are informational and are not legal, financial or political advice. Verify important facts with official sources.

6. Free polling

Creating an account, participating in polls, giving an opinion and viewing results on India Opinion are completely free. No payment is ever required for, or linked to, voting or giving an opinion.

7. Paid SaaS creator tool

Our only paid offering is an optional creator tool: a digital software service (SaaS) offered as monthly plans purchased inside the app. Depending on the plan, it includes AI chat and AI voice assistant features (AI chats, voice replies and AI call minutes) and one-click creation of shareable images and videos of poll results. The paid service has no effect on any poll, vote or result. Prices are shown in INR, inclusive of applicable taxes, before you pay. Where the tool is offered on a recurring basis, it renews automatically until you cancel it. Purchases made in the Android app through Google Play Billing also follow Google Play's payment and refund policies.

8. Payments

Payments are accepted only for the creator tool. They are processed by third-party payment providers; we do not store your card or UPI details. Cancellations and refunds are governed by our Refund & Cancellation Policy.

9. Payments do not influence polls or results

No payment, purchase or subscription influences any poll, vote, ranking or result in any way. Paying for the creator tool gives no additional votes, no visibility advantage and no ability to change, promote or suppress any question or result. We accept no money from any party, candidate or other person to promote or suppress any question or result.

10. Election compliance

The app follows the guidelines of the Election Commission of India (ECI). Poll results are opinion surveys of app users and are not official results. Results are hidden during ECI blackout periods, as applicable, including under Sections 126 and 126A of the Representation of the People Act, 1951.

11. Intellectual property

The app, its brand and its logo belong to Brain Hub. You keep ownership of your content and give us a non-exclusive licence to display it within the Service.

12. Limitation of liability

The Service is provided "as is" and "as available". To the fullest extent the law permits, we are not liable for indirect, incidental or consequential losses, or for decisions made on the basis of poll results or AI output. Our total liability is limited to the amount you paid us in the 12 months before the claim, or ₹1,000, whichever is lower. Nothing here limits liability that cannot be limited under Indian law.

13. Termination

You can delete your account at any time. We may suspend or terminate access if you breach these Terms or if the law requires it.

14. Governing law and jurisdiction

These Terms are governed by the laws of India. Courts at Aligarh, Uttar Pradesh, India have exclusive jurisdiction.
